Terms & Conditions

Understanding our agreement for heating upgrade services

1. Definitions

In these Terms and Conditions, unless the context requires otherwise:

  • "Goods" or "Upgrade" means the approved energy-efficient products and/or services supplied and installed under the Victorian Energy Upgrades (VEU) program, as set out in the Quote or Proposal.
  • "Customer", "you" means the individual, company, or legal entity receiving the Upgrade.
  • "Royal One", "we", "us", "our" means Royal One Pty Ltd (ABN [insert ABN]), including its employees, authorised agents, contractors, and subcontractors.
  • "VEU Program" means the Victorian Energy Upgrades program administered by the Essential Services Commission (ESC).
  • "VEECs" means Victorian Energy Efficiency Certificates created under the VEU Program.

2. Site Assessment and Eligibility

2.1 A site assessment may be conducted to:

  • Confirm eligibility under the VEU Program
  • Verify existing equipment or systems
  • Determine installation requirements
  • Collect evidence required for VEEC creation

2.2 The assessment is a visual inspection only. Royal One is not responsible for hidden, latent, or pre-existing conditions not reasonably identifiable at the time of assessment.

2.3 You or your authorised representative must provide safe, reasonable access to all relevant areas of the premises during assessment and installation.

2.4 Information collected may include measurements, photographs, serial numbers, and details of existing equipment as required by the VEU Program.

3. Quotes and Variations

3.1 All quotes are estimates based on information available at the time and are subject to confirmation of VEU eligibility.

3.2 Royal One reserves the right to amend or withdraw a quote prior to installation where:

  • Eligibility under the VEU Program cannot be confirmed
  • Site conditions materially differ from those assessed
  • Regulatory requirements or rebate values change

3.3 Any changes requested by the Customer after acceptance may result in a revised quote.

4. Installation and Compliance

4.1 All upgrades will be installed by appropriately licensed and qualified persons in accordance with:

  • VEU Program rules and guidelines
  • Victorian Building Authority (VBA) requirements
  • Energy Safe Victoria (ESV) regulations
  • Relevant Australian Standards (AS/NZS)

4.2 Royal One will collect and retain all evidence required for VEEC creation, including photographs and compliance documentation.

4.3 Existing equipment may be decommissioned in accordance with VEU requirements. Certain items may be left in place where removal is not required or practicable.

4.4 Royal One is not responsible for:

  • Pre-existing electrical, plumbing, or structural issues
  • Hazardous materials including asbestos
  • Insulation deficiencies or building defects
  • Cosmetic or minor damage resulting from reasonable installation works

5. Rebates, VEEC Assignment, and Customer Obligations

5.1 You irrevocably assign to Royal One or its nominated accredited partner all rights to create, register, and claim VEECs arising from the Upgrade.

5.2 The value of VEECs forms part of the payment for the Goods and services provided.

5.3 You must complete, sign, and return all documentation required under the VEU Program, including customer assignment and consent forms.

5.4 If:

  • Required documentation is not completed
  • Eligibility criteria are not met
  • Information provided by the Customer is false or misleading

Royal One reserves the right to invoice you for the full non-rebated cost of the Upgrade.

5.5 If VEECs are rejected by the regulator for reasons attributable to the Customer, Royal One may recover the equivalent rebate value from you.

6. Payment

6.1 Any customer co-payment specified in the Quote must be paid in accordance with the agreed payment terms.

6.2 Payments are deemed received only once cleared funds are received.

7. Warranties

7.1 Goods supplied are covered by the applicable manufacturer's warranty and any workmanship warranty stated in the Quote.

7.2 Warranties do not apply where faults arise due to:

  • Misuse, neglect, or lack of maintenance
  • Modifications by third parties
  • Environmental factors outside Royal One's control

8. Title to Goods

8.1 Title to the Goods does not pass to the Customer until:

  • All payments have been made in full, and
  • All VEEC assignment obligations have been satisfied

9. General

9.1 These Terms and Conditions apply to all energy efficiency upgrades performed by Royal One under the VEU Program.

9.2 Royal One may amend these Terms and Conditions from time to time to reflect changes in legislation or program requirements. The version in effect at the time of installation will apply.
